The mistreatment of Yong Sun Harvill and her family at the hands of the federal government, under the arm known as ICE is torture by neglect. The Department of Homeland Security Immigration and Customs Enforcement agency (ICE), while holding her for over one year, has denied this Korean-born Florida woman basic care for her many health problems. Care that would alleviate her daily suffering due to hepatitis C, high blood pressure, nose bleeds, panic attacks, sarcoma, psychiatric disorders and lymph edema (caused by cancer behind the knee), as charted by a Homeland Security Doctor.
When care is denied for medical conditions that "would cause deterioration of the detainee's health or uncontrolled suffering" this is torture by neglect. The previous quote is from the manual of the Department of Immigration Health Services, which decides who will live and die based on budgets and "treatment authorization requests" (TARs).
Mrs. Harvill may die as her cancer Dr. at the H. Lee Moffitt Cancer Center in Tampa, Florida wrote to the Doctor at the Federal Florence Service processing Center who had requested Mrs. Moffitt's records.
While Mrs. Harvill lingers in a county jail with no Doctor's care, her cancer remains untreated and possible liver, pelvic and colon problems are allowed to malinger. She has already served her time for convictions in Florida.
Her health continues to disintegrate from lack of proper medical diagnoses and care at the hands of our elected officials who expanded the scope of " aggravate felony" definitions to include her crimes of narcotics possession and receiving stolen goods. These debts to society have been paid and should not precipitate her suffering and death.
The physical and mental tortures she and her family are suffering are criminal. She should be released to receive the health care her husband has insured her for through his union. She is not a flight risk, as she wants to remain in this country with her family.
America is the ONLY home she has and will have, just like 32 previous years she lived here.

(워싱턴=연합뉴스) 이기창 특파원 = 미국 유력지 워싱턴 포스트는 12일 미 영주권자인 한인(韓人) 영선 하빌씨(52)가 이민자 구금시설에서 추방 위기에 놓인 채 비인간적 대우에 시달리는 참상을 1면 머리와 8-10면 3개면을 전부 할애해 대대적으로 보도했다.
워싱턴 포스트는 '무분별한 구금, 한 이민자의 수난'이라는 특집기사에서 주한 미군과 결혼해 1975년 미국으로 이민, 합법적인 영주권자로 살아온 영선 하빌씨가 법적으로 불분명한 사유로 추방 대상으로 분류된 뒤 이민자 구금시설에서 병마와 싸우며 1년도 넘게 비인간적 생활을 하고 있다고 전했다.
암 투병 전력이 있는 하빌씨는 구금 도중 각종 암 재발 증상들에 시달리고 있으나 치료는 커녕 진단조차 제대로 받지 못하고 가족들과의 면회 조차 허용되지 않은 채 이민자 구금시설에서 고통의 나날을 보내고 있다고 신문은 폭로했다.
영선 하빌씨의 이야기는 미 국토안보부 산하 이민세관단속국 구금시설에 갇혀있는 3만3천명의 추방 대상 이민자들이 얼마나 비인간적 대우에 시달리고 있는지를 보여주는 대표적 사례라고 신문은 지적했다.
1975년 주한 미군과 결혼해 미국 플로리다로 이주한 영선씨는 영주권자로서 30년 넘게 합법적으로 미국에 거주해왔으나 10여년전 장물 귀금속을 구입했다는 혐의가 문제가 돼 한국으로의 추방 위기에 놓였다.
영선씨는 친구와 타고 있던 자동차에서 마리화나가 발견돼 마약소지혐의로 13개월을 복역한 뒤 지난해 3월 풀려날 예정이었으나, 불법이민 단속 당국이 그녀의 전과 기록을 조회해 10여년전 장물 귀금속을 구입했다는 혐의를 이유로 추방대상자로 지목해 이민자 구금시설로 이송했다는 것.
영선씨는 당시 장물인 줄 모르고 귀금속을 구입했다고 주장해 집행유예 판결을 받았으며, 이후 유예기간도 무사히 종료됐다.
하지만 불법이민 단속 당국은 미국 영주권자라도 범죄 전력이 있을 경우 추방할 수 있다고 규정한 1996년 법률을 근거로 영선씨를 추방하려 하고 있다.
영선씨는 이에 따라 플로리다 교도소에서 애리조나 구금시설로 옮겨졌으나 육종이 재발한데다 조울증 증상까지 보이는 건강이 극도록 악화된 상태이다.
영선씨는 다리 부분의 종양이 3인치 크기로 자랐을 정도로 육종 증세가 심화돼 발목이 퉁퉁 붓고 진물이 나오고 있으며 자주 우는 등 우울증 증세까지 있지만, 치료는 물론 진단조차 제대로 받지 못하고 있다.
플로리다에 사는 남편 레온 하빌씨도 영선씨와의 면회 조차 허용되지 않은 채 아내의 석방과 귀환을 애타게 기다리고 있다고 신문은 소개했다.
워싱턴 포스트는 미 이민 당국자 모르게 영선씨를 수차례 직접 만나거나 전화로 취재하고 그녀의 옥중 일기를 토대로 특집기사를 실었으며, 영선씨의 결혼사진과 눈물을 훔치며 아내를 기다리는 남편의 모습 등 여러 장의 사진도 곁들였다.
영선씨는 "나는 우리에 갇힌 동물 같은 기분"이라면서 "때로는 내가 눈을 뜨지 못할지도 모른다는 게 걱정"이라고 일기에 적었다.
